MOTORCYCLE RENTAL AGREEMENT DRAFT

Motorcycle Hire Company (hereinafter “the Owner”:
Motoyard Ltd, 20 Ionos street, 5th floor, CY2406 Egkomi, Nicosia, Cyprus.
Office Hours: Mon-Sun 8:30 – 19:00
Age Requirements of the Renter:
Minimum age of 25, 3 years driving experience, 2 years motorcycle riding experience of particular category
Minimum age of 28, for the motorcycles over 1000 cc.
Maximum age 80
Driving License Requirements for the Renter:
No licence valid for riding in Cyprus (in accordance with Cyprus applicable Laws) – no hire
Riding Licence appropriate to the motorcycle category client intend to hire must be originally issued at list before 2 years before the time of rental
For non-European riders International Licence with category A must be accompanied with home country original licence.
The same apply to the additional rider
Payment:
A credit card (Visa or Mastercard) in the name of the main rider required in order to receive/collect the motorcycle (please note that the cards without the rider’s name will not be accepted). Company will not accept prepaid recharged or virtual cards.
A minimum of 20% of the rental fees will be taken at the time of booking (the booking deposit), which is not refundable. The balance of the rental fees will be due as per price timetable on the day of execution of the rental agreement and collection/delivery of the motorcycle
No partial refunds are made on early returns
The late returns are not allowed, in case of delay additional charge of 15 Euro per hour will apply (up to 3 hours of delay), above 3 hours of delay additional day of rent will be charged, after 6 hours of delay the penalty of not returning the Motorcycle of 200 Euro will be charged and If Motorcycle is not returned on the 6th hour of delay, unauthorised extension of the rental period is strictly prohibited, Owner reserves the right to take any action necessary to regain possession of the Motorcycle.
Deposits:
Before the Renter collect the motorcycle, we will take the security deposit from the Renter in the form of pre-authorisation against Renters credit or debit card. When Renter sign the rental agreement, he is also authorizing us to charge his card for any additional charges that he might incur (for example, rental extension, loss, theft, damage, fuel, traffic unpaid fines, other penalties) renters deposit will be released safely after motorcycle and other hired equipment have been returned safely and fully inspected by us. If the motorcycle needs to be cleaned before a full inspection can be made it is unluckily that we will be able to do this while you wait.
If you have been involved in an accident
Provided Renter do not have to deal with injuries at the first place, the first thing Renter should do is to take details of any other parties involved in the accident and any available witnesses, then inform the Owner of the accident. Renter should not move the Motorcycle from the place of accident before accident reported to police and/or insurance representative and relevant copy of the report is received. Renter are not authorized to admit any liability to anything on behalf of the Owner or Owner’s insurers
Renter should insure he has taken photo of damages and complete the relevant report, copy of which should be given to Owner’s representative
Damages, Theft, Abandonment
The Renter is obliged to fully compensate the Owner for any damages that may be caused to the Motorcycle at any point of rental period from any cause. Also in the event of theft of Motorcycle, Renter is obliged to compensate to the owner total commercial value of the Motorcycle. In addition, for as long as Motorcycle is immobilized for repairs after the accident, the customer is charged the fixed daily cost of 75 Euro per day for as long as it takes to repair motorcycle
Repairs will only be carried by our authorized mechanics and only at our instruction.
Insurance
Insurance is included in the rental price of each motorcycle and covers the Renter’s and additional riders third party liability only.
Liability wavier
Waiver certainly help to minimize the risk, expenses and likelihood of being sued. Damage waiver is an optional addition to Renters request and does have exclusions and limitations (subject of separate agreement to be provided upon request)
Taking motorcycle abroad or to occupied territories
Please note that prior authorization is required before crossing any boarders
Inappropriate use
Racing, time trials, track days, off-road use and motocross events are among the activities specifically listed and prohibited by our Rental Conditions and rental Agreement as well as commercial usefor things such as courier, taxi or delivery work. Non- compliance void insurance cover and if motorcycle is damaged at any time during the rental period then the Renter will be liable to the Owner and third parties for full cost of repair or replacement.
Some models and types of our Motorcycles can be used and taken off-road, subject to prior additional agreement and extra daily charge
Please note that all our Motorcycles are equipped with the latest technology GPS trackers.
Fuels
The cost of fuel is borne solely by Renter. Renter is obliged to return the motorcycle with exact the corresponding fuel content contained when it was received from the Owner.
Discharge of liability
The Owner is liable only in case of deceit of gross negligence. In all other cases (including slight negligence, blatant or force majeure), the Owner bears no responsibility whatsoever and no claim can be brought against him
Jurisdiction
It is expressly agreed that for any dispute arising out of the present lease, hire, rental agreement and attached to it terms and conditions courts of Republic of Cyprus are competent.
